By accessing or using our website, applications, AI systems, or communication services (collectively, the “Services”), you agree to be bound by these Terms.

GhostOPS AI provides AI-powered automation, messaging, voice, and conversational technology services, including but not limited to:

AI-driven SMS and MMS communications

AI voice agents and call handling

Workflow automation

Customer engagement and operational tools

The Services may involve automated technologies and artificial intelligence.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By using the Services, you represent that you meet these requirements.

3. User Responsibilities

You agree that you will:

Use the Services only for lawful purposes

Comply with all applicable local, state, federal, and international laws

Not use the Services for spam, fraud, harassment, or deceptive practices

Obtain proper consent from end users before sending messages using our platform

You are solely responsible for the content, legality, and compliance of messages sent using your account.

4. SMS / MMS Messaging Terms (A2P 10DLC Compliance)

a. Consent Requirement

You agree that all recipients of SMS/MMS messages sent using GhostOPS AI have provided prior express consent to receive messages.

Consent must be:

Clear and conspicuous

Freely given

Properly documented

Revocable at any time

b. Opt-Out Compliance

All SMS programs must support opt-out functionality. End users may opt out by replying STOP to any message.

Upon receipt of a STOP request:

Messaging must immediately cease

No further messages may be sent unless the user re-opts in

c. Help Functionality

End users must be able to reply HELP to receive support information, including:

Company name

Contact email or phone number

d. Message Frequency & Fees

Message frequency varies based on user interaction. Message and data rates may apply, depending on the recipient’s mobile carrier plan.

5. Prohibited Messaging Use

You may NOT use GhostOPS AI for:

Illegal content or activities

Phishing, smishing, or fraud

Deceptive or misleading messages

High-risk financial solicitation without authorization

Healthcare or financial messaging without proper compliance (HIPAA, TCPA, etc.)

GhostOPS AI reserves the right to suspend or terminate accounts that violate these requirements.

6. Data Privacy and Security

Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect personal information.

Carrier-Required Disclosure

GhostOPS AI does not sell, rent, or share mobile phone numbers or SMS consent data with third parties for marketing or promotional purposes.

7. AI Systems and Data Use

You acknowledge that:

AI outputs are generated algorithmically and may not always be accurate

AI-generated responses should not be considered legal, medical, or professional advice

You are responsible for reviewing and validating AI outputs before use

Customer data is used solely to operate and improve the Services and is not used for third-party advertising or external AI training without consent.

8. Account Suspension and Termination

We may suspend or terminate your access to the Services at any time if:

You violate these Terms

Your usage creates legal, regulatory, or carrier risk

Required compliance documentation is not provided

Termination does not relieve you of obligations incurred prior to termination.

9. Intellectual Property

All GhostOPS AI technology, software, branding, and content are owned by Mysaiah LLC and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services during your active subscription.

10. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.”
We make no warranties regarding uninterrupted service, accuracy of AI outputs, or fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, GhostOPS AI shall not be liable for:

Indirect or consequential damages

Loss of profits or data

Carrier blocking or filtering of messages

Regulatory penalties resulting from user misuse

12. Indemnification

You agree to indemnify and hold harmless GhostOPS AI from claims arising out of:

Your use of the Services

Your messaging content

Your failure to obtain proper user consent

Violations of A2P, TCPA, or carrier rules

13. Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile service provider and is outside our control.

14: Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
